iTallyiTally End User License Agreement
This agreement is between you and the 豹款影视制作车团队 (Efficient Film and Television Production Vehicle, "we", "us") about iTally (the "software"). The software is developed and maintained by us, and its copyright and related rights are ours. Installing, copying or using the software means you accept this agreement; if you do not, do not install or use it.
1. Licence
We grant you a non-exclusive, non-transferable, revocable licence to install and use the software on devices you own or are authorised to operate, to read and display the tally of switchers you own or are authorised to use. Members of your organisation may use it under the same licence; you may not redistribute it.
2. Ownership
The software, including its interface design, icons and marks, documentation and updates, is developed and maintained by us. Apart from the licence expressly granted here, the copyright and other intellectual property in the software remain ours and are not transferred to you by installing or using it. If you use the software on behalf of an organisation, you confirm you are authorised to accept this agreement for it.
3. Restrictions
- No redistribution, sale, rental or lending, and no provision of the software as a service to others;
- no reverse engineering, decompilation or disassembly, except where the law expressly permits it;
- no removal or alteration of copyright notices, trademarks or branding;
- no unlawful use, and no reading of switchers, networks or devices you are not authorised to access.
4. Safety (important)
Tally is shown for reference only. It can be delayed, interrupted or shown as Unknown because of the network, the switcher, the protocol or the device, and must not be your only way of telling whether you are on air; go by the director's calls and the switcher itself. iTally only reads: it never sends a switching or control command to a switcher. Losses from relying on the tally display alone are yours.
5. Trademarks
vMix, Blackmagic Design, ATEM, OBS Studio, TSL, Datavideo, Panasonic, Roland, Vizrt, TriCaster, Grass Valley, Ross and other names and marks belong to their respective owners. The software mentions them only to describe compatibility; iTally is not affiliated with, endorsed or sponsored by any of them.
6. Beta builds
Builds delivered through TestFlight (iOS) or Pgyer (Android) may be unstable and may lose local settings and preferences. We make no commitment about their availability or about keeping their data.
7. No warranty
The software is provided "as is", without any express or implied warranty, including warranties of merchantability, fitness for a particular purpose or non-infringement.
8. Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, including lost profits, lost data, damaged equipment or a lost broadcast. Our total liability is capped at what you actually paid for the software (zero for builds obtained from our own channels).
9. Third-party components
The software includes third-party open-source components and fonts, for example Bun, Hono, React, Expo / React Native, atem-connection, obs-websocket-js, MyGo and the IBM Plex Mono typeface. They are provided under their own licences, which prevail for those components.
10. Termination
The licence ends automatically if you breach this agreement. Uninstalling the software also ends it.
11. Changes and governing law
This agreement may change with new versions; the updated text takes effect when published on this page. It is governed by the laws of the People's Republic of China, and any dispute should first be settled through friendly discussion.

iTally 用户许可协议（EULA）
本协议是你与豹款影视制作车团队（下称「我们」）之间就 iTally（下称「本软件」）达成的协议。本软件由豹款影视制作车团队开发并维护，其著作权及其他相关权利由我们享有。安装、复制或使用本软件，即表示你接受本协议；若不接受，请不要安装或使用本软件。
一、许可范围
我们授予你一项非独占、不可转让、可撤销的许可：在你拥有或有权操作的设备上安装并使用本软件，用于读取并显示你拥有或经授权使用的切换台的 Tally 状态。你所在组织内的成员可在同一许可下使用，但不得对外分发。
二、知识产权与权利归属
本软件（含其界面设计、图标与标识、文档及随附的更新）由豹款影视制作车团队开发并维护。除本协议明确授予的使用许可外，本软件的著作权及其他知识产权由我们享有，不因你安装或使用本软件而向你转让。若你代表所在组织使用本软件，你声明已获授权代表该组织接受本协议。
三、使用限制
- 不得再分发、出售、出租或出借本软件，也不得将其作为服务提供给第三方；
- 不得反向工程、反编译或反汇编本软件（法律明确允许的情形除外）；
- 不得删除或修改本软件中的版权、商标与标识；
- 不得将本软件用于违法用途，或用于读取你无权访问的切换台、网络或设备。
四、安全须知（重要）
Tally 显示只作参考。它可能因网络、切换台、协议或设备的状态而延迟、中断或显示 Unknown，不得作为判断是否在播的唯一依据；现场的播出状态请以导播的通知和切换台本身为准。iTally 只读，从不向切换台发送切换或控制命令。因把 Tally 显示当作唯一依据而产生的损失由你自行承担。
五、商标声明
vMix、Blackmagic Design、ATEM、OBS Studio、TSL、Datavideo、Panasonic、Roland、Vizrt、TriCaster、Grass Valley、Ross 等名称及标识属于各自的权利人。本软件只为说明兼容性而提及这些名称，iTally 与这些权利人没有关联，也未获得其认可或赞助。
六、测试版本（Beta）
通过 TestFlight（iOS）、蒲公英（Android）等渠道提供的测试版本可能不稳定，也可能丢失本地设置与偏好。我们不对测试版本的可用性或数据保留作出承诺。
七、无担保
本软件按「现状」提供，不附带任何明示或默示担保，包括但不限于适销性、特定用途适用性与不侵权担保。
八、责任限制
在适用法律允许的最大范围内，我们对任何间接、附带、特殊或后果性损失（包括利润损失、数据丢失、设备损坏或停播损失）不承担责任；我们的累计责任不超过你为本软件实际支付的金额（通过我们自有渠道获得的版本对价为零）。
九、第三方组件
本软件包含第三方开源组件与字体，例如 Bun、Hono、React、Expo / React Native、atem-connection、obs-websocket-js、MyGo 和 IBM Plex Mono 字体。这些组件分别按其自身的许可条款提供，就这些组件而言，其条款优先适用。
十、终止
你若违反本协议，本许可自动终止；卸载本软件同样终止本协议。
十一、变更与适用法律
本协议可能随版本更新而调整，更新后的文本在本页发布即生效。本协议适用中华人民共和国法律；如有争议，双方应先友好协商。
